The petitioners seek pre-arrest bail in connection with Keoti P.S. Case No. 74 of 2017 registered under Sections 147, 148, 448, 341, 323, 504, 307, 506 and 379 of the Indian Penal Code.
Regard being had to the direct and specific allegation made against the petitioners no. 1 and 3, namely, Chandan Kumar Yadav @ Chandan Yadav and Harendra Yadav that they
Patna High Court Cr.Misc. No.41484 of 2017 (2) dt.19-09-2017 assaulted with farsa on the head of the informant, I am not inclined to grant them pre-arrest bail. Accordingly, their application for grant of pre-arrest bail is rejected. As far as petitioner no.2, Prem Lal Yadav is concerned, since there is no allegation of assault attributable against him, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Darbhanga in connection with Keoti P.S. Case No.74 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
