The petitioner seeks pre-arrest bail in connection with Bairiya P.S. Case No.156 of 2017 registered under Sections 341, 307 and 120B of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that there is admitted land dispute between the parties and in order to put pressure in the civil case, the informant and his uncle are filing criminal cases against the petitioner one after another. He
Patna High Court Cr.Misc. No.5413 of 2018 (2) dt.02-02-2018 2/2 submitted that in the alleged occurrence it is not even alleged that any one has sustained any injury.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.
Having regard to the facts and circumstances of the case and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, West Champaran at Bettiah in connection with Bairiya P.S. Case No.156 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
