The petitioner is in custody in connection with Bihariganj P.S. Case No. 230 of 2018 for the offences under Sections 323, 341, 307, 354(A), 379, 504, 506, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that no specific allegation of assault by this petitioner and petitioner is in custody since 11.01.2019. Learned counsel further submits that there is case and counter case between the co-accused Manohar Mandal and informant and other case bearing Biharganj P.S. Case No.231 of 2018 and the proceeding of Section 107 Cr.P.C. was also pending between the parties. Considering the fact that no special allegation of overact against this petitioner, the Court is inclined to grant bail

Patna High Court CR. MISC. No.29546 of 2019(2) dt.03-05-2019 2/2 to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Shri Abhimanu Kumar, Judicial Magistrate, 1st Class, Uda Kishunganj, District Madhepura, in connection with Bihariganj P.S. Case No. 230 of 2018.
