ANJANA PRAKASH ORAL JUDGMENT Date: 17-08-2015 The Petitioner seeks quashing of the order dated 11.08.2006 by which the Sub-divisional Judicial Magistrate, Patna in Complaint Case No. 3523(C) of 2005 has rejected an application under Section 205 Cr.P.C. which order was affirmed by the Sessions Judge, Patna in Cr. Rev. No. 959 of 2006 by order dated 27.07.2007.

In view of the express law laid down by this Court in matters under Section 205 Cr.P.C., the order dated 11.08.2006 by which the Sub-divisional Judicial Magistrate, Patna in Complaint Case No. 3523(C) of 2005 has rejected an application under Section 205 Cr.P.C. which order was affirmed by the Sessions Judge, Patna in Cr. Rev. No. 959 of 2006 by order dated 27.07.2007 is, hereby, set aside. The Application stands allowed.
