JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 05-12-2018 The present writ petition has been filed for the following reliefs - "(A) To issue a writ in the nature of certiorari setting aside the letter dated 19.10.2013 contained in letter no. 1462 by which respondent no. 5, the Superintending Engineer (Mechanical) Irrigation Mechanical Circle, Birpur was pleased to direct the petitioner as well as private
Patna High Court CWJC No.22483 of 2013 dt.05-12-2018 2/2 respondents to be present in the office at 2 P.M. on 23.10.2013 as tender/work would be awarded on the basis of lottery as seven firms have succeeded in technical bid and have quoted similar rate.
(B) To issue a writ in the nature of certiorari setting aside lottery dated 23.10.2013 for allotment of work by which works under group number-3 and 6 has been allotted to respondent no. 9 Shri Bijay Kumar and respondent no. 10 Akhilesh Kumar Das respectively.
(C) And/or any other writ/writs, order/orders, relief or reliefs for which the petitioner is found to be entitled in the facts and circumstances of this case.
2. Learned counsel for the petitioner submits that the writ petition has become infructuous by efflux of time and the writ petition need not be pressed.
