Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Fatuah P.S. Case No.86 of 2016 registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the deceased, daughter of the informant, by her husband and other in-laws for non fulfillment of the dowry demand.

Submission on behalf of the petitioner is that the petitioner is the brother-in-law (Dewar) of the deceased, the

Patna High Court Cr.Misc. No.55360 of 2016 (2) dt.11-01-2017 2/2 daughter of the informant, and has falsely been implicated in this case with an ulterior motive. Further submission is that the petitioner is separate in mess and property from the husband of the deceased and the co-accused Kiran Devi, who is mother-in-law of the deceased, the daughter of the informant, has already been granted anticipatory bail by a Bench of this Court vide order dated 20.12.2016 passed in Criminal Misc. No.53448 of 2016. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Ms. Jabin Jamal, Judicial Magistrate, First Class, Patna City (Patna), in connection with Fatwah P.S. Case No.86 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
