====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Dhanarua P.S. Case No. 479 of 2018, instituted for the offence under Section(s) 363, 365, 366, 366(A) and 120(B) of Indian Penal Code. Counsel for the petitioner submits that there is specific allegation in the written report against Diwana Singh of kidnapping the daughter of the informant.

The victim girl has given statement under Section 164 Cr. PC. wherein she has levelled specific allegation against co-accused Diwana Singh of kidnapping and taking her to Biharsharif. She has levelled general and omnibus allegation against the petitioner that he had hand in the aforesaid occurrence.

Patna High Court CR. MISC. No.25420 of 2019(2) dt.26-04-2019 2/2 Petitioner is in custody since 28.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, Patna, in connection with Dhanarua P.S. Case No. 479 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
