Petitioner apprehends his arrest in connection with Trial No. 1672 of 2017, arising out of Sakara P.S.Case No. 236 of 2017 registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
Petitioner happens to be brother-in-law and allegation against him is that he caused death of his sister-in-law. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner, rather final form has been submitted but learned Magistrate has taken cognizance against the petitioner and other accused persons. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.23679 of 2018 (2) dt.20-04-2018 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub-Judge, 13th, Muzaffarpur, in connection with G.R.No.2801 of 2017, Trial No. 1672 of 2017, arising out of Sakara P.S.Case No. 236 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
