The petitioner has been in custody since 27.05.2018 in connection with Salkhua P.S. Case No. 114/2018 registered for the offense punishable under Sections 341/323/307/302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that on the basis of a written report, the petitioner Lalan Yadav, Sajjan Yadav and Jago Yadav have been implicated in connection with the attack made on Upendra Yadav who subsequently succumbed to his injuries. Learned counsel for the petitioner further submits that though the allegation is that all the three had attacked the deceased, there is only one injury on the person of the deceased which puts the entire allegations under a cloud. It is also submitted that one of the accused persons,
Patna High Court CR. MISC. No.24910 of 2019(2) dt.18-04-2019 2/2 namely, Jago Yadav, father of the present petitioner, has since been extended the privilege of bail in Cr. Misc. No. 73654 of 2018 vide order dated 11.01.2019.
In view of the aforementioned facts and circumstances and also because the petitioner has no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Saharsa, in connection with Salkhua P.S. Case No. 114/2018.
