Petitioner is the sole accused named in Turkauliya (Raghunathpur) P.S. Case No. 333 of 2016 registered under sections 341, 323, 325, 308, 379 and 504 of the Indian Penal Code and prays for grant of anticipatory bail.

The allegation is that while the 12 years old son of the informant was playing, the petitioner manhandled/assaulted him and also tried to press his neck. When the informant arrived there, it is alleged that he was also abused and a theft of an amount was committed.

Contention of the petitioner is that even going by the F.I.R., it is a case of simple thrashing. The injury report does not support the case.

Patna High Court Cr.Misc. No.47774 of 2016 (2) dt.22-11-2016 2/2 Learned APP, on the other hand, submits that the doctor found injuries on the person of the injured. Looking to the nature of the allegation and the other materials available on record as well as reflected from the order of the Addl. Sessions Judge, I am not persuaded to extend the privilege of anticipatory bail to the petitioner. Prayer is rejected. Let the petitioner surrender in the Court below and seek bail.
