2. It is the first regular bail application submitted by the petitioners who have been arrested in connection with Muzaffarpur Rail P.S. Case No. 302 of 2024 for the alleged offences punishable under Section 319, 318(4), 338, 336(3), 340(2), 61(2) of the Bharatiya Nyaya Sanhita.

3. According to the case of prosecution, on 02.12.2024 officials of the railway police caught hold of the present applicants along with two other accused persons. On being searched some forged railway tickets were found in their possession. It is alleged that after preparing the forged railway

No.27458 of 2025(2) dt.06-05-2025 2/3 ticket they use to sell the same to the general public and original railway tickets were obtained by them from passengers and were returned to the railway department to encash the same, thereby, they committed cheating also with the persons from whom they have taken original ticket. On the basis of the information given by the informant offences has been registered and all the applicants has been been arrested on 03.12.2024 and since they they are in custody.

4. It is submitted by the counsel for the petitioners that the petitioner herein are innocent and are falsely implicated in this case. He further submits that the petitioners are in custody since 03.12.2024, investigation is still going on and charge-sheet has not been submitted yet, therefore, the trial will take much time. He prays that on these grounds they may be granted benefit of bail.

5. Learned counsel appearing on behalf of respondentState opposes the prayer of bail.

6. Considering the submission made by the counsels and further considering the detention period without commenting on the other merits of the case. I am of the view that the present applicant should be granted the benefit of bail. Accordingly, the petition is allowed. The petitioners are directed

Case No. 302 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties, to the like amount each to the satisfaction of the learned A.C.J.M, Railway, Saran at Sonpur.
