JUSTICE RAVI RANJAN ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 419, 420, 467, 468, 471, 466/34 of the Indian Penal Code.

It is submitted that, as per the allegation, the Deed of Gift was executed with respect to certain lands by the mother of the informant on 29.06.1999, however, the same was got registered after the death of his mother on 27.10.1999. It is further submitted that the petitioner is merely writer of the Deed of Gift, who has scribed the Deed of Gift. The execution and registration of the deed appears to be made in the year 1999 but the complaint case was lodged in the year 2014 after about 15 years, which was

Having regard to the facts and circumstances of the case, let the petitioner, namely, Azhar Hussain be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Ghorasahan P.S. Case No.247/2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-1st Class, Sikrahana, Motihari subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
