JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 34 of the Indian Penal Code.

The informant being roller operator submitted a written report that petitioner and other co-accused set fire on Poclain and Peloader machine and taken away cylinder, pipe etc from the machine.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. Though the impugned order reflects that during investigation some of the stolen articles were recovered from the house of the petitioner, but it is submitted by learned counsel for the petitioner that it is an error of record in the impugned order as the actual recovery was made from the house of other co-accused. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barhat P.S. Case No. 39 of 2012, pending in the Court of learned Chief Judicial Magistrate, Jamui.

With the observations above, the application stands disposed off.
