====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Dumariya P.S. Case No. 29 of 2017 for the offences registered under Sections 147, 148, 149, 307, 436 and 427 of the Indian Penal Code and 27 of the Arms Act.

It is alleged by the informantthat Yogya was being performed when Vikash Singh came there with gun. Thereafter, an altercation took place between him and one Sateyendra Prasad. Vikash Singh fired upon Sateyendra which hit one girl and people assembled there assaulted Vikash Singh who died there and mob thereafter became and went on rampage and destroyed and set on fire houses and shops.

It has been contended on behalf of the petitioner that he has committed no offence. There is general and omnibus allegation

Patna High Court Cr.Misc. No.4181 of 2018(3) dt.17-02-2018 2/2 against all the accused. No specific overt act is alleged against petitioner. The informant himself has stated that he shut down himself in a close room as such he is not eyewitness. Deceased Vikas Singh was his relative as such he has been named in this case as a counter case of killing of Vikash Singh. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sherghati at Gaya in Dumariya P. S. Case No. 29 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
