JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 08.01.2016 passed in Cri. Misc. No. 46022 of 2015, on the ground that the petitioner has been allowed bail in Motihari Muffasil P.S. Case No. 62 of 2014, confessional statement made before the police has got no evidentiary value in the eye of law and, as such, he deserves sympathetic consideration.

Learned A.P.P. opposes the prayer of bail by submitting that the petitioner has confessed his guilt and further snatched Scorpio vehicle has also been recovered with fire arms from the possession of the petitioner.

No.40388 of 2016 (2) dt.28-09-2016 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, considering the detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within six months.
