The petitioner seeks bail in connection with Naugachia P.S. Case No.29 of 2024 registered for the offence under Sections 392, 394 and 307 of the Indian Penal Code, Section 27 of the Arms Act and Section 37(c) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is to have committed robbery along with other other co-accused persons in

Patna High Court CR. MISC. No.31063 of 2024(2) dt.24-04-2024 2/3 the house of the informant, where, they have taken away jewelery box which contained jewelery worth of Rs.1.5 lakh, where, they were in drunken condition. It is also alleged that firearm injury caused to the son of the informant by this petitioner.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that nothing incriminating has been surfaced during course of investigation against this petitioner which may connect him with the present set of occurrence. It is further submitted that petitioner is in custody since 28.01.2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner and submitted that as per FIR, there is specific allegation as regard to causing firearm injury upon the son of the informant against this petitioner.

In view of the submissions, as made above, as there is specific allegation against this petitioner and other co-accused persons, who were entered into the house of the informant and committed robbery and fired upon the son of the informant, where, other co-accused were arrested by the police

Patna High Court CR. MISC. No.31063 of 2024(2) dt.24-04-2024 3/3 at the time of occurrence and as it appears from bail petition that there is six criminal antecedent against this petitioner like extortion, robbery, attempt to murder, SC/ST Atrocities, excise Act and he also convicted under Excise Act, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.
