JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 342, 504, 323, 427, 354 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that the informant's side purchased some lands from the Manjari Devi, mother of petitioner No. 1 through three sale deeds and subsequently mutation was done in favour of the informant. But, thereafter accused persons came abused by calling caste name, made assault, damaged tiles of the house and gave life threatening for retransfer of the purchased land of the informant. It is submitted by learned counsel for the petitioners that maliciously the ancestral lands of the petitioners have been transferred by the informant's side with frivolous means and for the occurrence of 06.12.2014 the
Patna High Court Cr.Misc. No.57220 of 2015 (2) dt.18-12-2015 2/2 complaint was filed on 08.12.2014 which came to be registered as police case on 14.03.2015.
Considering the delayed lodging of the case and the accusation being levelled in the background of serious land dispute, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui in connection with SC/ST P.S. Case No. 13 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
