This is and application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 342, 323, 324, 325, 332, 307, 186, 504 and 506 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner was one of the persons of the mob, who were protesting against the death of a person in road accident. The allegation that the petitioner assaulted the informant by means of broken glass, but the injuries caused to the informant was found to be simple in nature, which is evident from Annexure -2 of this petition. Heard learned A.P.P. also.
Having heard both sides and in view of the fact that though
Patna High Court Cr.Misc. No.52751 of 2016 (2) dt.21-12-2016 2/2 the petitioner assaulted the informant but the injuries was found to be simple in nature, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sr. Md. M. Alam learned A.C.J.M-III, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 86 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
