JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,380,452,504 and 323 of the Indian Penal Code.
The prosecution case is that the petitioner proposed to sell his land for a consideration of Rs.6,60,000/- out of which Rs.2,75,000/- was paid when the petitioner executed agreement to sale but subsequently neither the sale deed was executed nor the money was returned.
It is submitted by the learned counsel for the petitioner that the same cause of action the informant has filed an application for initiating proceeding under section 145 Cr.P.C. and the
Patna High Court Cr.Misc. No.55356 of 2015 (2) dt.07-12-2015 2/2 informant has also filed Title Suit No. 645 of 2015 before the SubJudge, Narkatiyaganj. Considering the nature of accusation in the background of litigated relationship between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Mainatand P.S. Case No. 89 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
