By the impugned order dated 03.02.2014, the learned Munsif, Banka allowed the intervention application filed by the respondent Nos.2 and 3 in Title Suit No.120 of 1996 recording a finding that the interveners-respondents are necessary party in the suit property because they have acquired interest on the basis of the registered gift deed.
It is not denied that there is registered gift deed in favour of the interveners/their ancestors with respect to the suit property. The grievance of the petitioner is that the gift deed is invalid and by that gift deed, no title passed to the donees. It may be mentioned here that so far this objection is concerned, it is inter
Patna High Court CWJC No.7945 of 2014 (2) dt.24-02-2016 se dispute between the plaintiffs. The interveners are claiming to be the legal representatives of the deceased plaintiff No.2. In view of the above position and the fact that the Court below after considering the registered gift deed has allowed the intervention application, I do not find any reason to interfere with the same in supervisory jurisdiction.
Thus, this writ application is dismissed.
