1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Bankey Bazaar Police Station Case No. 121 of 2024, dated 17.10.2024, disclosing offences punishable under Sections 127(2)/115 (2)/109/351 (2)/352/3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, as per the First Information Report, is that on 16.10.2024, at about 07:30 PM, the petitioner, along with other, came to the egg shop of the informant and started demanding money/extortion and when the informant demanded his money back, the accused persons started abusing the informant and the petitioner assaulted the informant by means of rod on his head and face, due

4. Learned Counsel for the petitioner submits that both the parties are co-villagers and he has falsely been implicated in this case due to ulterior motive. He further submits that the injuries sustained by the informant is simple in nature. He next submits that the petitioner is having no criminal antecedent.

5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both the parties are co-villagers, the injuries sustained by the informant are simple in nature and the petitioner has no criminal antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Banke Bazaar Police Station Case No. 121 of 2024, subject to the condition laid down under
