====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The grievance of the petitioner in the instant case is inaction on the part of the Housing Board in taking action in terms of the Bihar Housing Board Regulation 2017. Learned counsel for the petitioner submits that the original allottee Vindhyachal Prasad was allotted 20, MIG, Lohia Nagar Kankarbag thereafter the property was transferred in favour of Krishna Deo Prasad, Baldev Prasad, Sarada Devi and Manju Devi.

Patna High Court CWJC No.11032 of 2019(2) dt.16-05-2019 2/2 Learned counsel for the petitioner submits that the successor in interest Krishna Deo Prasad has written a letter to the Managing Director requesting therein to grant permission to transfer 1/4 share in 20, MIG, Lohia Nagar Kankarbag in favour of Baldeo Prasad.

Referring to the 2017 Regulation for grant of permission to transfer 1/4 shares of Krishna Deo Prasad in 20, MIG, Lohia Nagar Kankarbag. Mr. Singh submitted that the Housing Board has not decided on the request for transfer in terms of 2017 Regulation.

Learned counsel appearing on behalf of Housing Board submits that the Board will take appropriate decision in terms of the Regulation 2017 within a reasonable time. Considering the aforesaid, the writ application is disposed of with a direction to the Housing Board to take appropriate decision in terms of 2017 Regulation within a period of 90 days from the date of receipt/production of copy of this order.

With the aforesaid, the present writ application stands disposed of.
