1. Heard the parties.
2. Petitioner apprehends his arrest in connection with Hajipur Sadar PS Case No. 757 of 2021 dated 26-08-2021 registered under Sections 365 / 366 / 34 of the I.P.C.

As per the prosecution case on 18-08-2021 in the afternoon when the informant was going to her father's house along with her daughters and sat in a tempo at Ramashish Chowk, Hajipur, a woman already sitting there in the tempo started asking about the informant and told her that she was very upset and brought her to Patna on the pretext of providing her job in Haryana where the petitioner - Pappu Kumar and his cousin sister / Sanju Kumari were present. After keeping the informant in her tent at Patna, they took the informant to
Patna High Court CR. MISC. No.28971 of 2023(3) dt.30-08-2023 2/3 Haryana and forcibly asked her to indulge in prostitution for ten days for which she would get Rs. 10,000/- and when the informant refused, they started beating her. It has further been stated that when the informant somehow called her brother's friend from mobile, Pappu Kumar (i.e. the petitioner) along with other accused persons started demanding 01 Lakh and threatened to sell the informant and children for not paying the amount.

Learned counsel for the petitioner submits that there is contradiction in the statement of the informant inasmuch as in the First Information Report she has stated that she left the house of her husband and was going to the house of her father but in the statement recorded under Section 164 Cr.P.C. she has stated that due to some quarrel with her husband she left her husband's place and started for his father's home. It has further been submitted that petitioner is the son of the co-accused / Rita Devi @ Kusma Devi and is staying at Patna where the informant / victim was brought by his mother and the petitioner was not knowing about the intention of his mother and the co-accused / Sanju Kumari. The regular bail petition of the co-accused: Sanju Kumari and the mother of the petitioner has already been rejected by this Court vide Cr. Misc. No. 2907 of
Patna High Court CR. MISC. No.28971 of 2023(3) dt.30-08-2023 3/3 2022.
5. Learned counsel for the State submits that there is a gang engaged in human trafficking and they have created a chain of persons who allures innocent ladies for the purpose of prostitution.

Regard being had to the submissions made by the parties, taking into consideration the fact that petitioner was also present at the place of occurrence and in the house of the petitioner the victim / informant was brought, regular bail application of both the co-accused i.e. the mother of the petitioner and Sanju Kumari has been rejected and it is a serious offence for which custodial interrogation of the petitioner may be necessary, accordingly, I am not inclined to grant anticipatory bail to the petitioner.
