The petitioners seek bail in anticipation of their arrest in connection with Kotwali (Barari) P.S. Case No. 868/2017 dated 25.11.2017 instituted for the offences under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The informant is said to have been fired at by one Langra Yadav. The petitioners are alleged to have been sitting at the place where Langra Yadav was also sitting and having toddy. The informant was called by them and was also offered toddy. Thereafter, because of some dispute over sale of land, he was fired at by Langra Yadav leading to injury in his stomach. Learned counsel for the petitioners has submitted that
Patna High Court Cr.Misc. No.4271 of 2018 (2) dt.01-02-2018 2/2 no overt act has been attributed against them and that they have falsely been implicated in this case.
The petitioners do not have any criminal antecedent. Till the time, the anticipatory bail of the petitioners were disposed off, the injury report had not come on record. Considering the aforesaid facts, the petitioners above named are directed to be released on bail, in the event of their surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to their furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S.
