Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel for the informant.

The petitioner has been in custody since 20.03.2020 in connection with Hasanpur P.S. Case No. 236 of 2019 registered for the offences punishable under Sections 363/366A of the Indian Penal Code.

As per the prosecution case, minor daughter of the informant was kidnapped by this petitioner along with others for the purpose of marriage.

It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case as no such occurrence has taken place and, in fact, the victim is major and already married with Ram Dayal Kumar.

No.24278 of 2020(4) dt.07-12-2020 2/2 However, learned counsel for the informant has opposed the bail application and submitted that victim has supported the prosecution case in her statement recorded under Section 164 of the Cr. P.C. and she has specifically stated that this petitioner has forcibly took her on motorcycle and kept her in house of Chhote Lal Yadav. The medical board also assessed the age of victim between 15-16 years.

Considering the aforesaid facts and circumstances and the nature of allegations, I am not inclined to grant bail to this petitioner. It is, accordingly, rejected.
