2. Petitioner seeks regular bail in connection with Nawada Nagar PS Case No. 122/2013 registered for the offence punishable under Sections 341, 323, 324, 379, 304/34 of the IPC.

3. The allegation, as per First Information Report, is that the petitioner along with other accused persons surrounded the informant and assaulted him with Khanti, Sariya on his head due to which, the informant sustained injury.

4. Petitioner was granted bail by the learned court below on 17.05.2013 but he misused the privilege of bail and did not appear before the learned court below due to which, his bail bond was cancelled. The petitioner again misused the

Patna High Court CR. MISC. No.26472 of 2020(3) dt.23-11-2020 2/2 privilege of bail, due to which, his bail bond was cancelled on 27.04.2015. However, the petitioner was remanded in this case from another case on 11.09.2019 and since then, he is in custody.

5. Having regard to the submissions made by the parties and taking into consideration the material on record I am inclined to grant regular bail to the petitioner after framing of charge.

6. Accordingly, let the petitioner, KAILU SINGH be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3rd, Nawada in connection with Nawada Nagar PS Case No. 122/2013, after framing of charge, subject to the condition that petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
