JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 37(a) of Bihar Prohibition and Excise Act.

15 liter country made liquor is said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 31.12.2018. Moreover, having more or less, similar allegation, co-accused Samsool Hoda @ Shamshul Hoda has already been granted privilege of bail by a co-ordinate bench of this court vide order dated 30.04.2019 passed in Cr. Misc. No. 27955 of 2019.

Considering the aforesaid facts and circumstances as

No.32900 of 2019(2) dt.20-05-2019 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, Wesh Champaran in connection with Inarwa P. S. Case No. 66 of 2018.
