ANJANA MISHRA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Tiyar P.S. Case No.15 of 2016 for allegedly having committed the offences under Sections 341, 323, 325, 147, 148, 379, 308, 504, 506 and 149 of the Indian Penal Code.
Learned counsel for the petitioners submits that the present dispute is purely motivated and is the outcome of the dispute with regard to contesting the Panchayat elections. It is further submitted that there is also a history of land disputes between the parties. There is a case and counter case in which both the
Patna High Court Cr.Misc. No.39035 of 2016 (3) dt.06-10-2016 2/2 parties have sustained injuries.
Considering the facts and circumstances aforementioned and also because the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Raghubar Prasad Om, learned Judicial Magistrate, 1st Class, Bhojpur, Ara, in connection with Tiyar P.S. Case No.15 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
