JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered in connection with K. Nagar P.S.Case No. 257 of 2020 for the offences punishable under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code.

It is a case of free fighting between the informant and the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. No specific allegation levelled against the petitioners. There is general and

Patna High Court CR. MISC. No.36676 of 2021(2) dt.10-03-2022 2/2 omnibus allegation against these petitioners. Section 307 and 379 of the Indian Penal Code is not made out against the petitioner. Petitioners have clean antecedent. Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K.Nagar P.S Case No. 257 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
