2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 115(2), 117(2), 109, 74, 352, 351(2) and 3(5) of BNS. Later on, Section 103(1) of BNS was added.
3. The case of the prosecution is that the FIR named accused persons arrived at the house of the informant and started abusing and as the father of the informant came outside the house and objected, it is alleged that from iron rod and khanti, he was assaulted on his head and as he fell down, it is further alleged that the accused persons kept assaulting him. During the course of his treatment, he died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the FIR, it is clear that the name of this petitioner is not there in the FIR. The name of this petitioner has surfaced during investigation in the statement of one independent witness regarding which, it has been submitted that the petitioner is a witness in Shahpur P.S. Case No. 32 of 2024 which was registered against Ramlesh Kumar (independent witness who has implicated the name of this petitioner in this case). Learned counsel has submitted that Ramlesh Kumar the independent witness has settled his score by falsely implicating the petitioner in this case, however, the informant has not named this petitioner even in his restatement before police.
It is clear that the informant who is the eye witness of this case, has not named the petitioner at any place whereas two persons who according to the I.O. are the independent witnesses, have named this petitioner. Learned counsel has further submitted that during supervision, the supervising authority has exonerated the petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 16.03.2026.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail. Learned counsel for the informant has submitted that the name of this petitioner has surfaced in the statement of independent witnesses, namely, Ramlesh Kumar and Ramvilash Singh.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shahpur P.S. Case No. 94 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Nawada.
