The petitioner seeks bail in connection with Barahara P.S. Case No.280/2022, registered for the offence punishable u/s 420, 467, 468 and 469 of the Indian Penal Code. 3.
Allegation against the petitioner is that he has received SIM using forged documents.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to ulterior motive. No incriminating article has been recovered from the conscious physical possession of the petitioner. It is submitted that he has submitted genuine documents while purchasing the said SIM and as such, he is a
Patna High Court CR. MISC. No.29655 of 2024(4) dt.12-07-2024 2/2 bona fide purchaser of the SIM. The petitioner has no criminal antecedent and has been languishing in custody since 14.03.2024.

Learned APP for the State opposed the prayer for bail by submitting that there is ample evidence against the petitioner in the case diary.

Considering the facts and circumstances of this case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.
