The petitioner apprehends her arrest in Pupri P.S. Case No. 37/2016, registered for the offences punishable under Sections 304B, 201 of the Indian Penal Code.

The informant filed complaint case alleging therein that his daughter was married to Ajay Rai son of the petitioner in the year 2010 and his daughter got children, but the accused persons were demanding different articles. On 29.02.2016 all the accused persons assaulted his daughter Rinku Devi. Ajay Rai husband of his daughter assaulted Rinku Devi with iron rod on her head consequently she died on the spot.

Learned counsel for the petitioner submits that petitioner is mother-in-law of the deceased. Marriage was solemnized in the

Patna High Court Cr.Misc. No.39903 of 2016 (5) dt.15-11-2016 2/2 year 2010. After six years of marriage the present case was filed that too after four days of the occurrence. The informant participated in the cremation of the deceased, petitioner is motherin-law of the deceased and there is no specific allegation against her, but from perusal of para 53 of the case diary it appears that attachment order has already been issued against the petitioner and she had been declared absconder.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
