The petitioner apprehends his arrest in connection with Madhubani Town P.S. Case No.29 of 2016 registered under Sections 411, 413, 414, 401 and 120(b) of the Indian Penal Code. The accusation is that on suspicion, the Police apprehended two boys, who disclosed their name Md. Wasim and Md. Asaraf on 01.02.2016, who confessed their guilt about committing theft of L.C.D. T.V. and other household articles in the night of 30.01.2016 in Bankers colony detailing the name of their six associates, including petitioner, further submitting that their associates are present in the house of Md. Wasim. Thereafter, the Police reached there and apprehended to Arun Kumar Singh,

Patna High Court Cr.Misc. No.36647 of 2016 (2) dt.22-09-2016 2/2 Bindeshwar Mandal, Md. Samsad and Laxmi Sagar and later on, looted articles were also recovered.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that while the name of the petitioner has been disclosed by Md. Wasim and Md. Ashraf but petitioner was not found at the house of the Md. Wasim, nor any theft article was recovered from the house of the petitioner. It is further submitted that petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Madhubani in connection with Madhubani P.S. Case No. 29 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
