JUSTICE RAKESH KUMAR ORAL ORDER 21-09-2017 Heard Sri Bimlesh Kumar Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Dhanaha P.S. Case No.106/2017 registered for the offence under Section 30(A) of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail, in the event his arrest or surrender.. It was submitted by learned counsel for the petitioner that on secret information, a raid was conducted in the house of brother of the petitioner, namely, Ram Awadh Yadav, who was residing separately and from his house recovery of about 16 liters of country made liquor was shown and his brother, with whom the petitioner was not having good relation, had named the petitioner that the petitioner had kept the seized articles. Patna High Court Cr.Misc. No.44282 of 2017(2) dt.21-09-2017 2/2 statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent.
Considering the nature of accusation and clean antecedent, let the petitioner, namely, Hare Ram Yadav, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Dhanaha P.S. Case No.106/2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
