Perused the office note from which it transpires that this revision application has already been dismissed as against the opposite party nos. 1 to 3 and 5 to 13 in default for noncompliance of the order of the Court. The restoration application filed thereafter was also dismissed.

Mr. Chandra Kant, the learned counsel for the opposite party no. 4 has submitted that all the aforesaid opposite party nos. 1 to 3 and 5 to 13 are the necessary parties and they have all contested the matter in the learned court below as defendants.

In view of the aforesaid facts and submissions, this

Patna High Court C.R. No.237 of 2007 (8) dt.11-12-2015 Court finds that this revision application cannot proceed in absence of the opposite party nos. 1 to 3 and 5 to 13 on record. Accordingly, this revision application is dismissed as incompetent.
