The petitioners seek pre-arrest bail in connection with Supaul Mahila P.S.Case No. 97 of 2017 registered under Sections 341, 323, 448, 354-B, 379, 504, 506/34 of the Indian Penal Code.

The allegation against the petitioners is that on 24.06.2017 at about 2.00 p.m. three goats were grazing maize of the informant and when she raised protest the accused persons assaulted her by iron rod and accused Sikendra Singh made her nude by stretching her sari.

Learned counsel for the petitioners has submitted

Patna High Court Cr.Misc. No.41955 of 2017 (3) dt.21-09-2017 2/2 that all the six petitioners out of whom three are ladies have been implicated falsely in the present case due to land dispute. He has submitted that the petitioners are not involved in any other case and no serious injury was found on the person of the informant. Learned counsel for the State has opposed the application for grant of pre-arrest bail.

Regard being had to the nature of allegation and the facts and circumstances of the case, in the event of arrest or surrender, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul Mahila P.S. Case No. 97 of 2017, subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure.
