2. The petitioner apprehends his arrest in connection with Shambhuganj P.S. Case No. 233 of 2023 registered under Sections 366(A)/34, 504 and 506 of the Indian Penal Code.
3. It is alleged that this petitioner kidnapped the minor daughter of informant with intention to marry her.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that the victim girl, in her statement recorded under Sections 161 and 164 Cr.P.C. clearly stated that she is
Patna High Court CR. MISC. No.30789 of 2024(3) dt.13-08-2024 2/2 aged about 16 years and this petitioner has not kidnapped her. In fact, she went with this petitioner on her own will and has also solemnized marriage with the petitioner.
5. Learned A.P.P. appearing on behalf of the State opposed the prayer for bail.
6. Having considered the facts and circumstances of the case as well as the statement of victim recorded under Sections 161 and 164 Cr.P.C., let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum-Special Judge POCSO, Banka/Successor Court, Banka in connection with Shambhuganj P.S. Case No. 233 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
