2. The petitioner has preferred this application for grant of regular bail in connection with Khanpur P.S. Case No. 286 of 2024 dated 19.12.2024 registered for the offences punishable u/s 420, 417 and 406/34 of the I.P.C.
3. As per the prosecution case, the co-accused Rajiv Kumar persuaded the informant to deposit Rs. 1 lac in his Housing Finance Company and assured to give Rs. 5000/- per month as profit. He had given the said amount in the account of the informant as profit for few months. Thereafter, the informant and other persons on same allurement paid total amount of Rs. 16,12,700/- in the account of Rajiv Kumar and the petitioner. But when they did not return the paid amount. The FIR was
Patna High Court CR. MISC. No.25177 of 2025(2) dt.29-04-2025 2/3 lodged against Rajiv Kumar and Shahil Singh @ Manish Kumar @ Sahil Singh (petitioner). The petitioner is the employee of the said company.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to suspicion. As per the FIR, the informant paid the entire amount in the account of co-accused Rajiv Kumar and only being the employee of his company, the petitioner has been made accused in the present case. There is no material to show that the petitioner committed fraud with the informant. Chargesheet has already been submitted against the petitioner. The petitioner has two criminal antecedents in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 27.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Khanpur P.S. Case
Patna High Court CR. MISC. No.25177 of 2025(2) dt.29-04-2025 3/3 No. 286 of 2024, with the conditions ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii). If the petitioner is found involved in similar nature of offence in the future, the prosecution will be at liberty to move for cancellation of his bail bonds.
