JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 15-10-2025 Heard learned counsel for the petitioner and learned APP for the State. None appears on behalf of the informant despite notice being validly served. Perused the case diary.

2. The petitioner seeks bail in connection with Sitamarhi P.S. Case No. 537 of 2024 instituted for the offences under Sections 74, 79 of the Bharatiya Nyaya Sanhita, 2023 and Sections 7/8 of the POCSO Act.

3. Prosecution case, in short, is that on the alleged date and time of occurrence, the petitioner entered the house of the informant and teased his daughter and when the victim raised

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that from perusal of the FIR and even from the Section 183 BNSS statement of the victim, it is evident that there is only allegation of teasing against the petitioner but there is no allegation of outraging the modesty of the victim is alleged against the petitioner. Learned counsel further submitted that petitioner is being dragged in this case merely due to some previous enmity. Learned counsel further submitted that charge-sheet has been submitted and cognizance has also been taken against the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.08.2024 and has one criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two
