2. In this case, the petitioner is seeking regular bail in connection with Rajpur P.S. Case No. 112 of 2023, registered for the offences punishable under Section 379 of the Indian Penal Code Read with Section 136 of the Indian Electricity Act.
3. As per allegation, some unknown thieves stolen away electricity wires.
4. Learned counsel for the petitioner has submitted that except confessional statement of co-accused, there is nothing against the petitioner. He has submitted further that co-accused in whose confessional statement the name of the petitioner was figured has been granted bail. The petitioner is in custody since 20.12.2023.
5. Considering the above-mentioned facts and

No.36177 of 2024(3) dt.05-07-2024 2/2 circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 112 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
