JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Government Official Complaint Case No. 188 of 2019 registered for the offence punishable under Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.
The petitioner's prayer for grant of regular bail was earlier rejected by this Court by an order dated 18.12.2019 passed in Cr. Misc. No. 69869 of 2019 with a liberty to renew his prayer for bail after six months. It is alleged that from a Tata Sumo vehicle 159 liters of Indian made foreign liquor was recovered. The petitioner was found occupying the said vehicle.
Patna High Court CR. MISC. No.22931 of 2020(2) dt.22-01-2021 2/2 Learned counsel appearing on behalf of the petitioner has submitted that the petitioner was simply found sitting in the said vehicle.
Considering the observation made by this Court while rejecting petitioner's prayer for regular bail by an order dated 18.12.2019 passed in Cr. Misc. No. 69869 of 2019, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Nawada in Government Official Complaint Case No. 188 of 2019.
