Petitioner apprehends arrest in a case registered for the offences punishable under Section 323 and other allied sections of the Indian Penal Code as well as sections 25 and 26 of the Arms Act.

Prosecution's case in brief is that the petitioner and two other co-accused persons, all named in the FIR, went to the house of the informant and started abusing him and his daughter. The petitioner on the point of country made pistol tried to drag his daughter but due to alarm raised by him villagers and other family members came there and snatched the pistol. Accused persons managed to escape in the meantime. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He submits

Patna High Court CR. MISC. No.27250 of 2020(2) dt.06-11-2020 2/2 that the instant case is the counter blast of Complaint case no. 2729/2019 filed the brother of the petitioner. Petitioner has got no criminal antecedent.

Learned counsel for the State opposes the prayer for bail submitting that there is specific allegation against the petitioner that he hurled filthy words on informant's daughter and tried to drag her out of the house on the point of pistol. Considering the gravity of the allegation against the petitioner his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
