====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Khajauli P.S. Case No. 09 of 2019, instituted for the offence under Section(s) 147, 149, 341, 323, 324, 307, 354(B), 448, 382, 504 and 506 of Indian Penal Code.
Counsel for the petitioner submits that allegation against petitioner is of assaulting the informant with Farsa on his head causing bleeding injury to him. He further submits that there is case and counter case between the parties. The informant and his family members also assaulted the petitioner and his family members, for which, petitioner has filed Khajauli P.S. Case No. 07 of 2019 against the informant and others. Petitioner is in custody since 13.2.2019 having
Patna High Court CR. MISC. No.26651 of 2019(2) dt.26-04-2019 2/2 clean antecedent.
The injury report of the informant has been enclosed as Annexure-3 wherein the Doctor has found simple injury on his head caused by hard and blunt substance. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Madhubani, in connection with Khajauli P.S. Case No. 09 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
