Petitioner is apprehending arrest in connection with Mahila P.S.Case No.103 of 2019 for the offence under Sections 376(D) of the Indian Penal Code.
Learned counsel for the petitioner submits that earlier application for anticipatory bail was rejected on 21.01.2020. He further submits that he has filed the second application for grant of anticipatory bail Learned counsel for the petitioner seeks permission to withdraw the present application with liberty to the petitioner to approach the court below for grant of regular bail. Permission granted.
The petitioner, if so advised may approach
Patna High Court CR. MISC. No.23345 of 2020(3) dt.04-11-2020 2/2 before the court below and pray for regular bail which shall be considered on its own merit on the same day without being prejudiced by the refusal to grant anticipatory bail to the petitioners.
