Petitioner seeks regular bail in connection with Nawada (Nagar) P.S. Case No. 245 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
A total quantity of 8.5 liters of illicit liquor kept in a bag which was tagged in a motorcycle driven by the petitioner was recovered by the Police.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case with oblique motive and he has not committed any offence in the manner alleged. He further submits that the petitioner is in custody since 01/03/2021 and charge sheet has already been submitted. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 01/03/2021 ,
Patna High Court CR. MISC. No.36413 of 2021(2) dt.06-01-2022 2/2 charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II cum Special Judge, Nawada in connection with Nawada (Nagar) P.S. Case No. 245 of 2019 on the following conditions:- (i) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
