2. The petitioner apprehends his arrest in a case registered for the offence under Sections 302 & 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, on 11.11.2020 at about 9.30 PM, co-accused Munna Ravidas came at the house of informant and took his son with him for fishing. It is further alleged that after some time, when informant went there, he saw that co-accused Munna Ravidas alongwith 4-5 unknown persons were fighting with his son and soon thereafter, co-accused Munna Ravidas took out a pistol from his waist and fired at informant's son, as a result of which, son of informant died.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.31109 of 2024(5) dt.09-09-2024 2/2 petitioner is not named in the F.I.R. and his name transpired during course of investigation. Learned counsel further submits that as per F.I.R. itself, specific accusation is against co-accused Munna Ravidas, who is alleged to have shot dead informant's son.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna City, Patna in connection with Nadi P.S. Case No. 183 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
