The petitioner apprehends his arrest in Sonepur P.S. Case No. 361/16 registered under Sections 47(A)(1)(F)(E), 51, 52, 54 of the Bihar Excise (Amendment) Act, 2016. The police got information that some persons had come on a four-wheeler near the betel shop of Vishnu Bhagat and they were selling liquor. The police went there and saw the petitioner and the petitioner and others started fleeing away from the place of occurrence. One Maruti Suzuki Swift Dzire and one motorcycle were seized. The petitioner is the owner of the motorcycle. Nothing has been recovered from the motorcycle. 18 bottles of Royal Stag Premier Whisky, each containing 250 ml, were recovered from the seized Maruti vehicle. The petitioner is not the owner of the Maruti Suzuki Swift Dzire.

No.55298 of 2016 (2) dt.11-01-2017 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Saran at Chapra in Sonepur P.S. Case No. 361/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
