====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 14-09-2020 Heard Mr. Ajay Mukherjee, learned counsel for the petitioner and Mr. Manoj Kumar 1, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Jaipur P.S. Case No. 11 of 2020 registered for the offence punishable under Sections 366/34 of the Indian Penal Code 1860.

The allegation against the petitioner is that he along with other co-accused abducted 19 years old daughter of the informant for the purpose of marriage. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to

No.23611 of 2020(2) dt.14-09-2020 2/3 village politics inasmuch as from perusal of the First Information Report it appears that the daughter of the informant was being taken on Motorcycle by one Bullu Kumar Choudhary. Learned counsel further submits that the victim girl has been recovered and she in her statement recorded under Section 164 Cr. P.C. has stated that some persons whose faces were covered, abducted her and she was forcibly married to one Vishal Choudhary in presence of some women folk. Learned counsel further submits that the victim girl in her statement recorded under Section 164 Cr. P.C. has not stated anything against the petitioner and the petitioner has got no criminal antecedent. He is in custody since 24.03.2020.

Having regard to the submissions made by the parties and taking into consideration the materials on record and also the fact that the victim girl has not stated anything against the petitioner in her statement recorded under Section 164 Cr. P.C., I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of

Patna High Court CR. MISC. No.23611 of 2020(2) dt.14-09-2020 3/3 Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Banka, in connection with Jaipur P.S. Case No. 11 of 2020 It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
