Petitioner admits that he is getting monthly pension but it is urged that all other post retiral dues of the petitioner have not been paid as yet though the petitioner has retired in February, 2015 as Associate Professor, Department of Chemistry, Parwati Science College, Madhepura being a constituent college of B.N.Mandal University.
A counter affidavit has been filed on behalf of the State
Patna High Court CWJC No.18713 of 2015 dt.16-05-2016 2/2 mainly stating that necessary funds have already been released by the State Government.
Having regard to the aforementioned facts and circumstances, this Court would be inclined to dispose of the matter with a direction to the respondent no. 3, the Registrar, B.N.Mandal University, Madhepura to immediately examine the case of the petitioner and ensure payment of the admitted retiral dues within a period of two months from the date of receipt / production of a copy of this order. In case some of the dues are not found payable to the petitioner then he would be required to pass a reasoned order and immediately communicate that to the petitioner. Since it is stated on behalf of the State that necessary funds have already been released it is further clarified that if the admitted dues of the petitioner are not paid within the aforesaid period then the petitioner would be entitled for simple interest @ 10 % per annum upon the admitted unpaid amount to be calculated from the date the same became due till the date of its final payment.
