JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 This is an application for grant of anticipatory bail in connection with N.T.P.C. Khaira P.S. Case No. 18 of 2019, disclosing offence under Section 30 (a) of the Bihar Excise (Prohibition) Amendment Act, 2016.
Allegation of recovery of 260 liters of liquor from the Tempo and one person was arrested, who has disclosed that the liquor was being taken for supply to the petitioner. Submission of the learned counsel for the petitioner is that except the above said disclosure there is nothing against the against and no recovery was made from the possession of the petitioner.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail.
Having heard both sides, considering the fact that there is only confessional statement against the petitioner, this

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-cum-Special Judge -VIII (Excise), Aurangabad (Bihari), in connection with N.T.P.C.Khaira P.S. Case No. 18 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
